A 60-YEAR-OLD man has been accused of breaching the Health and Safety Work Act which resulted in the death of a pensioner in a construction yard.

Alan Paxton is charged with failing to maintain proper observations and driving a vehicle which struck 72-year-old Ian Hogg, resulting in fatal injuries.

The offence is said to have happened at the premises of Walker Groundworks Ltd at The Old Smiddy in Kelso on May 10, 2022.

Paxton, of Broomlea, Kelso, had his case continued without plea at Jedburgh Sheriff Court until September 9.
