A KELSO teenager who showed a picture he had taken on his mobile phone of a woman asleep in her underwear to another person without her knowledge has been ordered to pay a total of £570 at Jedburgh Sheriff Court.
Nineteen-year-old Daniel Ball claimed he had been trying to prove to a friend he had been with the woman on the date the picture was taken, when he showed him the intimate image at the Black Swan Hotel in Kelso on July 14.
But depute fiscal India McLean said the woman was unaware the picture had been taken and was upset when she heard Ball had shown it to another person.
Defence lawyer Ed Hulme said his client had been reckless in showing the image to a friend.
Ball was fined £300 with a £20 victim surcharge for showing an intimate image of another person likely to cause alarm or distress without their consent.
He was also ordered to pay her £250 compensation and banned from having any contact with her for two years.
